International Workshop “International Commercial Law: Present and A Decade Ahead”

On the morning of July 11, 2023, the VNU University of Law held an international workshop: "International Commercial Law: Present and A Decade Ahead". 



The workshop attracted the participation of a number of leading experts in the field of International Commercial Law, including Assoc. Prof. Dr. Hoang Phuoc Hiep (Former Director of the International Law Department, Ministry of Justice and Dean of Faculty of Law, Hanoi University of Business and Technology); Dr. Nguyen Nhu Mai (Former Director, Department of Legal Affairs, Government Office); Assoc. Prof. Dr. Nguyen Tien Vinh (Director, Tran Nhan Tong Institute, VNU); Dr. Charalampos Giannakopoulos (CIL Center for International Law Studies, National University of Singapore); Prof. Park Ki-Gab (Member of the International Law Commission, United Nations); Dr. Lawyer. Le Dinh Vinh (Director of Vietthink Law Firm) and many other domestic and foreign experts and scholars.



Speaking at the opening of the Workshop, Assoc.Prof.Dr. Nguyen Thi Que Anh, on behalf of the VNU University of Law, expressed her thanks for receiving the great attention of many experts and scholars, especially Dr. Lawyer. Le Dinh Vinh and Vietthink Law Firm for sponsoring the workshop. According to her, International Commercial Law has a significant impact on many conventional legal fields in Vietnam. As a result, experts need to examine and provide particular development orientations for the field. Therefore, she expected that the workshop "International Commercial Law: Present and A Decade Ahead" would allow scholars to discuss and approach new information and knowledge on this hot topic. 



The workshop was divided into 03 sessions, at the end of each session, scholars participated in a discussion and Q&A session

Session 1 was moderated by Assoc.Prof.Dr. Nguyen Tien Vinh and Dr. Charalampos Giannakopulous with 6 presentations, including:

Vietnam and International Trade Policy in a New Context (Dr. Nguyen Thi Thu Trang); Some features of the new generation Free Trade Agreement (FTA) to which Vietnam is a member and the development trend of the FTA between ASEAN and outside countries (Dr. Tran Anh Tuan); The application of WTO and FTA regulations to the Carbon Border Adjustment Mechanism and Recommendations for Vietnam (Assoc. Prof. Dr. Nguyen Ngoc Ha); Developing international rules on digital trade, e-commerce, and cross-border data transmission: Analysis of EVFTA and CPTPP (Assoc. Prof. Dr. Tran Viet Dung); Integrating urgent regional needs into reform of multilateral dispute settlement mechanisms between investors and host countries: Proposals for ASEAN (Dr. Charalampos Giannakopulous); International trade obligations of the US import ban on Myanmar gems and its implications for the Thai gem industry (Prof. Jaruprapa Rakpong).



Session 2 was moderated by Prof. Dr. Nguyen Ba Dien and Assoc. Dr. Tran Viet Dung with 6 presentations:

Legal framework on facilitation of international trade at Vietnamese seaports (Dr. Nguyen Nhu Mai); Specific challenges of International Commercial Law for Vietnam's maritime industry in the context of the digital era (LLM. Nguyen Dinh Thuy Huong); Platform Provider Liability and Digital Commerce Matters (Dr. Nany HUR); Jurisdiction in cross-border e-commerce (Assoc. Prof. Dr. Tran Thu Phuong); Data Protection Issues in International Commercial Law: Impact of GDPR on International Trade (Prof. Tamás Fézer); The Future Global Framework for International Commercial Litigation - The Hague Convention 2005 and 2019 (Prof. Peter Arnt Nielsen).

Session 3 was moderated by Assoc. Prof. Dr. Nguyen Thi Que Anh, including 5 presentations:

Summary of the bachelor's program in International Commercial Law at the VNU University of Law (Assoc. Prof. Dr. Nguyen Thi Xuan Son); Human resource needs and skills requirements in International Commercial Law (LLM. Lawyer. Nguyen Thanh Ha); International commercial law training: Opportunities and challenges (Prof.Dr. Nguyen Ba Dien); Integrating "sustainability" into the curriculum of International Commercial Law: The Vietnam Case (Dr. Do Viet Cuong); The precedent in WTO dispute settlement: Some suggestions for integrating precedents in the curriculum of International Commercial Law program at the VNU University of Law (Assoc. Prof. Dr. Nguyen Tien Vinh).
